if you are involved in an accident and you go 50 / 50 on fault does each insurance company pay for the third parties car or does the insurance pay for their own clients car.

i was hit at a junction last night it is not my fault at all but i gather that the lady who hit me wants a 50 / 50 i dont want to claim on my insurance as i am able to fix the car myself as its only minor damage.

where do i stand with this ?

as much help and advice as possible please.(y)
 
Stick to your guns, tell her to bo**cks. Your not to blame, its better for the insurance companies her way, but thats not what you pay your premium for.
 
i know i am totally not to blame and i just hope the cctv camera that was facing the junction at the time was recording. the police also took photos after the incident. all of the broken glass etc was well in my side of the road which is another way of proving it was not my fault. she cut the corner so tight when theoretically she should have waited at the give way lines as i had entered the junction.

she didnt even look where she was going and didnt see me until she had hit me. i am very lucky i saw her coming and not looking and stopped the car in hope she would either see me and move or miss me out of luck.
 
I'd let your insurance company sort it out....If you even remotely hint that you're to blame in any way, then her insurance company will nail you....
 
Usually rear-end shunts are blamed on the person who has hit you from behind. I wouldn't allow anyone to get a 50/50 even if it was my fault.

Just let the insurance company deal with it.

I dont see anything to suggest it was a rear end shunt?

More a corner cutting or a "turning right / left into a junction" bump.

Its a good idea to let the Insurance companies deal with it but insist on your innocence IMO. Photos would be good.

Insurance companies like 50/50 for their own reasons, Knock for Knock I think they call it, but if you are certain you in no way contributed stick to your guns.
 
yeah she hit me front drivers side headlight and corner of the bumper. i am in no way at all liable for the accident and im sure 100% that if the camera was recording that it would show me to be completely truthful and also that i stopped and it hopefully will also be good enough to show that she didnt even look in my direction until she hit me.

i am not going to let it go but i will be certain that if i can prove that she is at fault then i will make sure her insurance company pay for my damadge because i shouldnt have to pay for that.
 
never go 50/50 if you can help it you may lose your ncd.i got crashed into rear and pushed into car in front my insurance co went 50/50 lost 2 years no claims :bang:
 
ive got protected no claims bonus so should be ok if thats the worst. i had my car up on the ramp and it needs jigging theres a lot more damadge there than i thought. all of the radiator is pushed right up and its broken all the heat shield. with a new bumper front panel and headlight and the labour to refit and paint it is well over 1k so i have my suspicions it will be a write off
 
could well be at that price think you need to get on to your insurance find out what they doing about it:mad:
