Right my insurance is 850 for the year I have just renewed my insurance n I have just had a accident the other person had not logged that accident I rang my insurance n told them as the police said I have to it's come out that my car is going to be a right off total loss I was going to claim but they have valued my car at 1000 but then said if I claim I will have to pay the full payment of 850 and then pay my 350 access so I will end up oweing them money I have 2 years no claims is this right what they are saying or are they having me over
 
You can't claim off an insurance policy and expect to not pay for the policy doesn't work like that I'm afraid. If you got a sofa on finance and then destroyed it..you are still liable to pay the duration of the finance regardless.

However if you are getting a new car the claim should not be taken into account until your renewal date, so it may be worth keeping the policy going and swapping the new car on if it hasn't been cancelled already. This would hopefully be cheaper than a new policy with a new provider with 0 ncb and a recent accident on record.

Do you have the insurance details of the driver who was at fault?
 
Yeye got that mate but my insurance are trying to say it's my fault
 
looking at the numbers on your first post again you would be far better off not making a claim. Plus your no claims discount will be unaffected if you don't claim.

That's what's am having to do now
 
What happened? Did you go into the back of them?

This would be the important question.

If OP is being asked for an excess you would assume it was their fault. It which point the deciding factor is if the other side makes a claim. If they do then may as well take the payout as the policy will be paying out to repair the other side as well (which the OP doesn't appear to have factored in to his profit and loss calculations for some reason).

Obviously if it was a single vehicle accident it's then fairly simple case of claiming or not unless property has been damaged as well.
