Sorry for not posting in the leisure lounge, It's blocked here.

My problem is, i've bought some spacers recently which I had to send back due to not fitting, despite saying they fit grande puntos.

The spacers cost £59.99 and to send back was £7.95.

Now it seems they want £10 to send them back to the supplier then they will refund my spacers, but not the £10.

Here is the email:

Basically, I just want to confirm that I have read that email right and that they will not refund the £10. Also, am I right in asking for the delivery costs back? It is not my fault they do not fit therefore why should I fork out to send them back and forth.

If they really do not fit then the responsibility is theirs surely.
One thing i have learnt from buying and selling on Ebay is even if the buyer is in the wrong they still have more rights/power than the seller.
If you are not in a rush for the money back launch a dispute!
Obviously you will get it back eventually but only after the seller caves in:devil:
 
Honestly mate they don't fit. Won't even fit on the wheel flush. Impossible to drive with. They've accepted that and have got in touch with their supplier but yet expect me to pay for them to send it back to their supplier...if im reading the email right?
 
WE WILL ONLY ACCEPT RETURNS IF THESE ARE SUPPLIED INCORECTLY AND YOU HAVE ADVISED US OF ALL CORRECT VEHICLE DETAILS. RETURNS FOR "IVE CHANGED MY MIND" WILL NOT BE ACCEPTED.
well good news for you. as I've said before, you can actually send it back and have a refund under the distance selling regulation. unfortunately not many people understand this reg so don't fight it!

If I'm reading the msg that they sent you correct. there asking for the postage to send it back to the supplier? or just back to them?

if it doesn't fit like you say it would be returned as a 'defected' or 'not fit for safe usage' product meaning THEY should be paying for the return postage. as they have sold you a faulty product

Yeah i've asked for confirmation on that then I have it in writing. but yeah he meant back to the supplier, on top of the £7.95 i've already paid to send them back to him.

The guy has been fine with me over the phone, but obviously the arrangement isn't great. Thanks mate

Bo**ocks.
If you gave them the correct details of the car and then spacers they sent out do not fit then it is their fault alone. They should replace the incorrect spacers with the correct ones free of charge. You should not be paying postage for them to correct their error.

Unfortunately the Distance Selling Regulations do not cover purchases made via PayPal if this is how you paid. I was told by PayPal that as PayPal is not UK based organisation, UK law does not apply. Crazy world :bang:

Yeah im gonna have to. I mean, what they're offering is OK. Theyre offering to send me some that fit, refund the cost of the old ones, minus delivery. And that is where they fail, "minus delivery". It should be "including delivery". And for the record, I haven't asked that they include the new ones, I just want a refund on the ones that didnt fit
