0the garage is now saying that they cant prove who hit my car but i can prove it was done there cos the sercurity guard at my work says i can see the cctv tapes and maybe make a copy of friday morning

Gutted mate!

Best to have the timing belt done asap really, just to be on the safe side

Sli as a security consultant i can safely say that if the garage has a cctv system that is pointed atyour car duing the time that it was damaged they gave a legal obligation to make the tape viewable to you. What i mean by that is they are obliged to let you watch it but not to provide a copy as this breaches the privacy laws. If they refuse to show them to you, you are within your rights to make a formal complaint to the police asking that they contact said garage and ask them not to destroy/copy over the tape/s for the times you specify. It would then be prudent for you to contact your insurance and ask them if they are willing to make a claim against the garage in question as they are proving difficult to negotiate with also i would mention to your insurance that they have cctv of the incident and they are unwilling to make it availible for you. Your insurance is then obliged by law to contact the garage asking for the tape to be mailed to them. It is then left in the hands of your insurance to claim back. By the way does the garage have a sign up specifying that they have a cctv system in operation? Please answer this question to the best of your ability as they must display a sign outside of the premises otherwise i will have some more advice for you.
