I'd like to say thankyou to all of you for your help with my little seicento since i got it, its had its ups and downs, however its had its final down...

it got written off by a 44tonne artic lorry yesterday in dover :(

Ouch, considering the size of the beast hitting you I'm surprised that's the only damage!

I give it 10 minutes before the vultures swoop in and start asking for bits ;)

Can I have the front bumper ;)

i no longer have it, i had it from 4pm the day it happened (wed) until 3pm yesterday, its now gone to kap who will probably declare it as a write off, and im now driving a 1.2 micra pmsl. courtesy car FTL.
 
Lorry was in the outside lane on a roundabout, cut across to go round it and went into the back of my car.

As you can see here, the lorry is in the outside lane...

And if you look to the top left you can see him cut across, then you see the ar$e of the trailer stopped. thats where he stopped after spinning us 180 degree's and wrecking my car :mad:

From how you describe it it sounds like the lorry was in or heading into the outside lane but the roundabout was too tight so it came across into the other one, he should have checked it was clear before doing this and is at fault really if the roundabout is clearly marked into individual lanes, but also you shouldn't have been trying to dart past a lorry on a roundabout (sorry). Unless that's not what happened at all.

The two insurance companies are likely to arse around for ages bickering over this, I'd get and buy another motor now if you can afford it, rather than wait for the cheque (if you ever get one, incident with my brother's Cinq was never resolved. Roundabout where you can't see who is coming from the right from where he was, fog and the other driver going far too fast, apparently).
 
I see your point, however, we were already on the roundabout, the lorry didnt stop at all entering it, so pulled up practiclly along side us, then proceeded to go around the roundabout, he was in the wrong lane and when the police spoke to the guy he said i was in the wrong lane, and he explained to the police where i was/where he was etc, and even they said he was in the wrong.

the bit that pi$$ed me off is when the copper said they cant prosecute at all as he hasnt committed a crime :/ surely NOT obeying british road laws is a crime, in this country the driver on the roundabout has right of way, where as in some european countries the person entering the roundabout has right of way. but at the end of the day, he didnt stop at all, says he didnt see us. im thinking its a lack of concentration/attention tbh.

either way, i bought a 1.4 vw golf today, mk3, 7 months mot, tax til end of the month, for £175. runs fine, gotta sort me insurance on monday but im not sure if i can insure/run another car whilst ive got a claim in progress? i hope so as i hate the new shape micra theyve given me as a courtesy car :(
 
We really need pictures or video to make a proper judgement. The linkies don't work.

It does sound like the HGV was acting properly. They ARE allowed to use multiple lanes at a roundabout. Lane ONE (nearside) at a three lane roundabout is fine as long as they were indicating to signal their intention to go around the roundabout. It is other road users responsibility to anticipate an arctic may use multiple lanes and have reduced visibility.

If there was no injury to either party the police won't prosecute and have no duty to even take details of drivers. It's a simple case of both drivers exchanging details. They may have requested a breat test but thats about it.

My bet is the insurance will say equal responsibility or the HGV insurance will just cough up.

Still sucks for the poor sei though :D

//edit -- knowing a few HGV drivers, it's also hard to see whats going on and also stop 50 odd tonnes of vehicle without risk of serious implications. The 750KG sei would have stopped on a 50 pence piece if needed too.

My insurance company have the CCTV footage now and have said they can clearly see he is in the wrong as he isnt signalling etc.
 
failing to give way is an offence, was it traffic police or normal

Normal, they turned up, diverted traffic, got me to park the sei in a local garage forecourt, got the lorry drive to park down a layby, exchanged details, he got breathalyesed (sp?) and his tacho checked, and then sent on his way,

My insurance company is aviva and theyve been very understanding with it, im just hoping it dont go 50/50 as my excess is 1,500 :bang: Stupid insurance prices because its a sporting!! (n)
