Yeah. Good advice imo. The dealers had their window of opportunity, not used it and its now at the next level. Don't feel any urgency to contact the dealer out of courtesy.

But like s130 generally alludes to, just make sure from here on in you follow the prescribed route....... whatever that is and keep all documents/ emails/ records.

To be honest I find it amazing that they've done what they have over a clutch pedal, surely there was some solution which would have remedied this for a few hundred quid max. it'll cost them a lot more now.

I have been down this road, before the new right of refusal within 30 days for any fault, and it is hard to understand the mind set of some dealers. Quite apart from their own costs. they ended up having to pay me more than £2000 on top of what I paid for the car in costs, interest, loss of wages etc. This was much more than fixing the fault. In theory, because of the wording of the court decision, I could have keep the car and got the money back but I don't act like a rogue car trader.

All I would add is to reinforce the need for the letters as well as any emails. If you accumulate evidence, you could also consider consulting local trading standards.
 
One more thing. Refrain from communicating verbally in person or over the phone if possible, as this could be a minefield if things get messy and it's comes down to one sides version of events vs the others. Just insist on all the correspondence being written, especially with the dealer.

Remember that email is considered as the same level of authority as a letter so as long as they have acknowledged receipt of at least one email from you to the address you are sending, email should be good enough. No harm in a letter back-up for important stuff. Obviously keep all emails. If you do make phone calls or they call you, keep a note of the date time and subject and anything important said. These can be used as evidence. When my case went to small claims court the judge was happy to accept a scribbled note on the back of an old Tesco receipt as evidence of what was said when the garage called me. The garage had no record so the Judge took my version. Hopefully Dean won't have to go to court, but you can't make notes later.

Quick update sorry for the delay but changed phone and there was no app.

They dismantled the clutch and found it to be faulty. Think it was the matter cylinder had leaked and fluid had contaminated the clutch plate. Its a lot easier to press the pedal. It made no difference to the height of the medal but just being easier to operate makes it totally different.

They're still to change the creaking clutch pedal, the dealer had argued over this but one the grease dried out that they apply then the creaking comes back. They've argued that this is a characteristic of the car and that they'd tried for others in for service and they did the same but I could not ree thir cars conveniently as they were customers. They are fitting a third stereo as they believe the vibration from the dash board is something rattling inside not one but two stereos. Not convinced myself but I not the technician.
