From what I've read, you've been sold a dud car with a worthless warranty.

As you've bought it recently, you have rights under the Consumer Rights Act 2015.

Unfortunately I suspect that enforcing those rights may prove to be as difficult as getting the car repaired properly; I doubt either will be straightforward.

Dualogic faults can be an absolute nightmare to diagnose and fix; franchised dealers generally approach this by replacing major components and the cost often runs into thousands of pounds. Whilst there are sometimes other repair alternatives, finding anyone capable of working out what is needed is not easy; most independent garages have neither the experience nor the capability of diagnosing and fixing dualogic issues.

I feel desperately sorry for you. You paid good money for the car and didn't expect this.

Personally I'd explore the possibility of enforcing your rights against the selling garage before you start messing with it. If you bought the car in England, then English law will apply - I don't know how different things are in Scotland, nor how easy it will be for you to find someone local who can advise you on this. However I do know that used car dealers know every trick in the book when it comes to avoiding their legal obligations; I doubt it will be straightforward.

I'm hesitating to post the link as I don't want to depress you further, but this thread gives you some idea of the problems others have had with these transmissions.

Thank you for your message i dont think i will ever get my money back but i will get all the advice i can to pursue him he knows i am disabled and it took me years to save that money so my advice is never buy a car from Sutton Motor sales
 
4 Month warranty but when i contacted them they would not process a claim because no service history been in touch with consumer services and phoning Trading standards in the morning i sent seller letters and text but no replies .

I take it they have provided it with some sort of third party warranty then rather then provided by the garage themselves?



Anyway service history shouldn't have any effect on the gearbox as there's no service items in it everything is supposed to be for life
 
yes it was a third provider not sure what you mean about being for life ?

Providing a third party warranty does not exempt the selling dealer from his obligations under the Consumer Rights Act. If the car isn't fit for purpose, the dealer still has to either fix it, or refund your money.
 
I have been in touch with customers advice and they are helping pursue him they also said they would let trading standards know about what is going on but i will have to wait and see what happens but keeping fingers crossed some good will come from this but not sure will take time to get some form of conclusion .
 
my fiat keeps sticking in 1st gear so car wont start it says on forum to check transmission fluid but have no idea how to check it it works fine sometimes and then just sticks in first gear disabled so need my car can anyone help ?
I had similar issue. likely the hydraulic fluid just needs topping up. Make sure you put it in the plastic bottle which is fixed to top of gearbox?

thank you will check is it a certain fluid i need to use a brand for fiat cars
 
They don't "use" the fluid. If it's low, something is wrong.
The only non-leak problem I can think of is when the accumulator membrane fails, letting the normally gas-filled section fill up with fluid.
This is also the only situation where I would recommend changing the fluid. Tutela CS-Speed fluid, between £10 and £25 a litre, depending on where you buy it.

However, if it has a leak, a "top-up" might get you home from a fairly local breakdown, or possibly fool some poor buyer into believing all is well, but it won't fix anything.

Occasionally it is possible to have an actuator leak and not know, as the fluid leaks into the gearbox. But usually there's easily-seen evidence of a leak.

But if you are going to pursue the warranty claim..
do NOT fiddle with it !!

They need to get the inspector to see the poor condition it is in NOW..

that is the point of your claim.


Agree.. its a similar scenario to Brake fluid.. Its a sealed system.. a moderate amount will migrate around the system with component wear..

LOSS of fluid is another FAILURE :(
 
thank you for all the comments i am not going to do anything until i see what is going on with my complaint sent him another letter to ask if he would use a consultancy to come to an agreement but so far no response he has just over 1 week to respond if no response i will get back in touch with consumers advise to see what the next step is, think its small claims court but not sure.
