Olive is in the garage as i write they seem doubtful they will to fix the drafty problem its up under dash and to do with the air circ flap not closing properly they say might have to strip the front inside out dash etc new heating parts or something, dont like the idea of that what if things rattle or have more problems when put back in, are they qualified enough to do that (just asking don't want to offend!!!) what would you do?

They can have three goes at attempting to fix it before you are entitled to reject it and if it isn't fixed then you are entitled to reject it but not before I hope this helps.

As Ulpian says you have to give them 3 goes at fixing it. That is the law. They will be the best qualified people to do that sort of work on the car at this point in time.

If you are to reject the car, then you must stop using the vehicle immedietely and inform the dealership of this by recorded post. The longer you leave it the harder it will be to reject the car.

I have just rejected a vehicle and it is a hard process, :bang:I had to employ a solicitor to do this. Check out the Consumer direct (Trading Standards) website, and The Consumer Action Group website. I found these sites to be of use.

Whatever you decide to do best of luck!(y)

THe thing is the OP has no legal recourse to reject the car at this point in time so whilst what you say is helpful you're a little premature ;)

I did not have to give the garage three attempts at fixing, this was what the solicitor advised, and the car was rejected. If you are to reject a vehicle you must carry it out swiftly. There are time constraints.

Okay well thanks for the advice, this is their 2nd attempt i just a bit worried about them stripping it out at the front. Best of it is they have never had this problem before.....Poor Olive....

I personally think you'd have to be very unreasonable to reject a car without giving the dealer the chance to rectify the problem but that's just me :)

32newton it will be fine and if not you give them the chance to sort it again and if it doesn't get sorted you reject it :)

a car is a series of sub assemblies and the sub assemblies are made up of many components that all fit together. sometimes one of more of these components does not fit or function correctly

the only reason to reject a car is if problems are so widespread that it will never be 'right'

if you do succeed in reject it what will you do, wait 3 months for another that may also have a few teething troubles?

new cars have niggling problems, accept it, get them fixed and move on

Yaeh I agree if it is one minor fault, then it would be unreasonable. Unfortunetley I had eleven faults, two being serious. And I lost total confidence in that particular vehicle, and have since had no problems with the replacement.

I am by no means pushing in the OP into rejection of the vehicle, I just wanted them to be aware of rejection being time critical and oganisations that me be of help, and like I said previously it is a tough process, not to be taken lightly.

well, update they have contacted Fiat for instruction on the repair so will now just have to wait and see hopefully everything will be fine so keeping me chin up...until i Collected her tonight  inside is filthy with finger prints and greasy spot marks on the seats, console panels, steering wheel, doors looks like they've sprayed somthing inside as its in blotches, oh and they've managed to scuff and scratch the drivers door sill, so chin is beginning to droop a bit now.Back to dealers tomorrow:bang:

Also, if you reject the car and its accepted you'll get no kind of courtesy car or anything until your New car arrives.

IMO I'd give the dealer a chance to fix it, if you have problems after, then take it from there. I've had various problems with my Abarth and Fiat/Abarth HQ have been quite good with dealing with them.

removing dashes in modern cars is easy/quick compared to days of old, problem is dirty fingerprints left on panels!

That very true, my dealer just fitted a new heater valve this morning...
Plus my long awaited replacement drivers seat cover, apparently they were real bast-rds jobs..............
When I picked the car up this afternoon everything was perfect, no rattles, fingermarks.......... you wouldn't have known anyone had worked on it(y) Carstins of Balsall Common

Olive has been back to the garage this morning, I expressed my opinion  and they said they will sort it, she has been returned to me and i am now much happier(y) they have done a good job, the part is on order to cure the draft so i just have to wait for now.

If its of any reasurance we had to have the complete aircon unit changed in the Abarth so dash out & all the carpets & seats had to come out as the carpets were sodden. Westover did the work & we didnt have a single creak or rattle & the car also recieved a mega valet so it can be done if the dealer has a mind to. Expressing your concerns before they start is a good idea & tell them your very picky & as there are no rattles now you dont expect any when its done !
