Yer... it has to be sold at auction im told! Bcos it has never technically been mine even though i paid for it But the finance company that the guy borrowed the finance from; well in the eyes of the law are the owners! Basically its because the garage messed up, with the hpi check But the garage assure me they will defiently buy my car back for me and return it in the condition it left! I am worried/angry; i find the best way to releave my stress is by thrashing the courtesy car, because its the garage owners personel car (well so im told)! But i will create the biggest fuss if my car has been scratched, etc..

I would be worried if their plan goes "tits up".

You know who will do best out of this possibly? The garage! If they buy the car back tomorrow for less than market value (after all it's at auction) and manage to claim back the money through small claims for the idiot who sold it without owning it, then they could well be quids in!

Go to the auction and bid against the garage just to piss them off

Make sure you check every little detail on the car to mate. Even if its very minor scrathes tell em you want a respray

Well wednesday is here and im not getting my car back, today

Seems the garage are going against there words and cant really be arsed; well thats what it feels like at the moment!

Grrr.. i cant explain how angry this has made me, after giving them a chance to do the rite thing then they just basically cant be bothered

Though before i let the car go i made the garage sign an agreement that if they didnt return my car, that they would refund me in full and pay my expenses! So they will not be getting away with this!

But im going down to the auction to buy my car back, which will leave me broke having to pay for it twice

But shouldnt be to bad, when i get the money back from the garage; then maybe i will be a few quid in pocket as cars usually go for cheaper at the auctions!

I hope that agreement is legally binding......you don't want to pay for it twice! What idiots, can't believe they have done that.

Hopefully you will get a good deal at the auction. Don't tell the garage what you paid...

You will definitely get your money back from the garage as they must have title to any goods they sell. You will also be entitled to costs if you incurred any.

The only concern is that they suddenly go out of business, I have know idea how big they are.

The guy who traded it in also committed fraud as he would have had to make a signed declaration to say the car was free from any loans secured on it. It is a criminal offence, although he is unlikely to be arrested for it.

This is the sort of thing that really makes my blood boil. The legal system in this country is a f***ing joke. If you buy a car in good faith, and it turns out to be dodgy, the seller should be held responsible. Instead, the poor bugger who buys the car loses it and gets f-all of the cost back. What moron thought that one up???

Sad but true, even if somebody owes you money and you get a court ruling it can still take months and months to get it back. You also have to pay all the legal costs in the meantime.

The garage were a bit stupid not to check it though.

Hmm, don't I know it, my landlord from last year is a w***er and still owes me my deposit (I moved out in June last year!). Think I'm gonna skip all that expensive and tedious court s***e though and just find out where he lives, then spend an evening waiting outside his house with a baseball bat

this happens to loads of people, i reckon if you rent anywhere and have paid a deposit, dont pay your last few weeks/months rent and get it back that way

Just a quick word here :
Its quite possible that the guy who sold/traded in the car did not know there was any loans secured on it..
When my mum got her new car, she just took out a loan with Fiat thinking it was like any other loan that she had i.e secured on her property..
Nobody explained a thing to her about the loan and it wasn't untill i did some digging around that she found out otherwise..
The garage did not at any point tell her it was secured on the car.
Maybe there should be a law that states these things must be made clear in a verbal statement.
