W Reg Fiat punto sporting 16v KNACKERED

Bought the car 2 months ago on a W Reg plate , from Bristol Trade centre, (used cars big dealers), took out 2 years Mechinical Breakdown insurance (should it mess up , then i get £300 once garage has rang in the problem).

But 2 months later.....

<present time>
It is knackered, when i drive it seems like its missing, it also seems that the revs drop low between 10-30k revs
There is also a creeking noise from the rear, the brakes also seem to be rubbing.
So i ring my local fiat dealers, to be told to wait 2 weeks (booked in for this friday) , took it into local garage been told its to do with air intake (i.e. when you push throttle fast, it 'clunks') and also this is a common prob on these models of fiat, and that the garage confirmed this. However i speak to fiat garage (who are unresponsive and arrogant because as yet they havent had my money or custom) and they explain "never heard of it before on new car...."

So i wait, the car is getting worse everytime i drive it...
Probably taking next week off work...

All my life i have bought cars £50-£600 that have lasted 2-6 months as run arounds, i finally have a bit of cash and i treat me and my young family to a nice car (around 6k) and it dont last no longer...

I am feeling almost sucidal over this, as i dont have the money, ppl have mentioned warrantys and stuff, but as yet have no idea what the problem is , or how much i will be expected to pay...

I am so gutted and depressed... any help apprecaited !

please mail me , karaoketoolz@blueyonder.co.uk as i can check this mail from anywhere (especially if i do go back to work during the week) ... mail me even if you have replied so i know to check.....

You won't have to pay anything, take it back.
Change in laws state that any problems in the first few months have to be sorted by the garage unless they can prove it wasn't knackered before they sold it.

IANAL.. AIUI...

from Monday 31 March 2003 there was a change in consumer law:

The amendments give entitlements to choice of repair, replacement, reduction in price or recission with reimbursement of price (reduced to take account of use), subject to some conditions. There is also an onus placed on the seller, within 6 months of delivery to rebut a presumption that any defect discovered was present at the time of sale.

You don't need Watchdog, or Auto-express, the law is on your side [:0]
