I've had another communication from the council:



"Thank you for your e-mail, the contents of which are noted.

I understand that your personal circumstances are difficult and have no wish to impose additional stress, I also appreciate that you are trying to address the issues, however it can not remain unresolved indefinitely. If you have anyone else who can act on your behalf I would be happy to deal with that person.

The complaint (s) related to the amount of vehicles you have parked at the property, making the site look like a scrap yard, and the adverse impacts this has on the residential amenity.

In the terms of planning legislation, as previously explained, parking cars on a domestic drive would not normally require express planning permission. It would be considered a use incidential to the enjoyment of the dwelling house., provided the number of vehicles are considered to be reasonable for personal domestic enjoyment. It is the amount of vehicles you are keeping at the property that is causing the issue and has resulted in a breach of planning control. Having between 10 and 12 vehicles kept on the land is clearly far in excess of what would be reasonable for personal domestic enjoyment. The Council is trying to achieve a situation whereby you have no more than 4 vehicles parked at the site. It appears that you are unable to do this within a reasonable time scale.

What I need from you is a commitment to reduce the number of vehicles to no more than 4 no later than 31st March 2016. You have to be aware that if you fail to comply with this request then it is likely that an enforcement notice would be served. If this course of action becomes necessary I will fully explain the process and procedure at that time, but I hope that course of action can be avoided.

I trust that the above clarifies the position for you and look forward to hearing from you again."


To be honest I'm just sick of the whole saga now it's been going on for ages. The Uno and the Parade are also up for grabs for a good offer.

They include any parked in the garage in the 4 figure. It is arguable that I can keep an extra 2 dailies on the road outside my house.

I'll keep Henry, Colour, Selecta and the Y10.

Mk3 lives on the road at the moment and is used daily.

So that's the parade, Uno, charlie and possibly the ex-selecta that need re-homing, (I'd like to keep and restore it abit if storage can be found).

A similar case ended up the defendant being allowed to keep 6 but at what cost in lawyers fees?

I'm tired and just want to sort this out so I can get on in peace.

If anyone knows any serious buyers for the cars mentioned pass on my details, or alternatively, has secure dry storage for a nominal fee where I can stash a pair I'd be grateful.

I love my little collection and it's very hard to let any of them go but what choice do I have?

This is all a bit rubbish John(n)

I can't see how they would think 6 cars is unacceptable, that would be two in the garage, two under your car port and then two on the drive/road as required. Most people probably wouldn't even realise there were more than two vehicles then!

Would finding storage for the caravan help at all? Might be easier to find storage for that than the cars?

If anyone wants to come and look at the Parade at my workshop then that's fine, just let me know.

Are the cars taxed?
Could you just not park some on the public roads around your house and keep 4 on your premises?
Can't think how hard is being told to get rid of the cars!
 
I've seen the facebook and posted a picture of the parade.

I'm hoping to put a couple away somewhere but storage round here is non existent, I'd be on thin ice parking on the road locally, though if I could find an empty drive or two that'd be handy.

The keepers are all mot'd though some are sorned. I'm reticent to park too far away from home as none of the cars has any security so could be at risk, also for insurance purposes they are parked on the drive at night.

If anyone can offer some dry storage for a nominal sum I'd be interested!
 
Its often worth giving citizens advice a go, doesn't cost anything and they might be able to give you a better argument for having the cars you do, just because you're a car enthusiast shouldn't mean you can't keep them on your own property. You could argue that one of your neighbours has too many cats and could the council ask for some of them to be disposed :rolleyes:
 
Weren't they worried you were acting as a trader? So to avoid being construed as a trader of cars they want you to sell as many as possible as fast as possible!??

The faintly condescending tone of the letter is irritating.

Really? What a load of cobblers - how many people do we know who don't consider it's "clearly" in excess, let alone "far in excess".

I really don't see how there can be a limit. There is no planning needed to park a car, as far as I know. I'd just park all the flaming things on the road (legally, then what will they be able to do) & knacker up the other neighbours' parking.

Why can't people mind their own business? (n)
 
I would just park the car legally on the road and the ones you care more about on your drive/ garage
Then call the council for an inspection and see what they say...
Don't get rid of the cars! You will regret it dearly
 
really, i would fight that. talk about taking your rights away. i really would just tell them to do one.

under what law do you have to remove them?

where does it say you need planning permission to have cars?

no one can physically come on your land and move the cars without a court approved warrant and that would be pretty hard for them to get when no laws are broken.

if i didnt care for a view out of the house i would just have a massive fence or wall put up around the garden. those who complained can have that to look at instead.

i'd love to see the council try to remove things from my owned residence where no laws have been broken.

i also like how they say they will tell you what would happen at the end time. i'd request to know everything. the only reason why they would do that is the hope that the law would change in that time to be in there favour.

i would also ring around all of those no win no fee lawyers they are all 0800 numbers so you can talk to them as much as you want.


but of you just want the easy way out i guess sell up. i know id fight for my stuff though.

surely the council could only prosecute you for an offence within the laws
I cannot see any breach of any laws in keeping 10/20/30 cars....
I would send them all the documentations of your cars (road tax/mot/insurance etc.)and see what they reply
I am sure they cannot do nowt if you park the cars in the public roads as well
 
Ahh, they have the parked cars on a residential street thing covered also, it was me parking 3 cars legally on the street which led to the complaints originally, I think the vindictive little Hitler who complained would be back onto them ASAP if I did so again.

They already know the details of all my vehicles as I was requested to submit registration numbers to them (and was threatened with the contravention notice if I didn't). The police have already attended the street regarding these issues and requested me to park on the kerb outside my house.

Besides, I have driveway parking for 7 cars, why would I want to park on the road?

Seriously, any takers for Charlie?

If you have space for 7 cars on the drive and more in the garage then I don't see why the council are trying to make you lose some cars. It's your property and there's no law that says how many cars you can have or how many cars you have to have to be deemed a trader, and in fact selling off the cars seems like a strange way for the council to deal with it as that's almost like a trader thing to do anyway :p

I have a mate that's looking for a classic Fiat but the VIP is a bit out of his budget. I hope you don't mind but I gave him details of your Parade, I'll let you know if he wants it :)

They're all MOTed and roadworthy. Just because they're of various ages how does it make it look like a scrap yard? :mad:

How dare they. If in various states of disrepair I could understand it, but this isn't the case.

Perhaps they should look at their office scrap yard, sorry car park, and reduce the number of vehicles??!

Have you got legal cover on your home insurance? If so give them a call, will often cover you for this sort of thing.

Everybody has the same reaction to this, they can't believe that it isn't legal to keep what you want on your own driveway/property, unfortunately the council has a myriad of regulations to counter freewill and freedom of expression.

I'm taking a step back from the legalities of this and letting go of what I can but it does smart quite a bit.
