Has anybody had any dealings with this lot?
They apparently manage (if that's the right word) car parks by having cameras mounted at entrances and exits, and record the registration number. If you overstay they send a "Parking Charge Notice".
My son recently visited South Mimms services for a car meet there that was officially sanctioned. He gave his reg to the hotel and was told he would not get a ticket.
One week later, he got one of the PCN's. He emailed an appeal to them on my advise (right or wrongly I don't know) and sure enough yesterday we got a very clear letter back that the charge was cancelled and nothing to pay.
Today we got a letter saying that the appeal was unsuccessful but they would put the charge on hold for a further 14 days if we choose to provide further evidence relating to the appeal.
Should we just ignore it from now on?
 
i like the innocent till proven guilty aproach.
but i would leave and see if anything comes from it.
get a photocopy of letter incase any debt recovery agent comes and you can always say it must be still in dispute then. as advice from watchdog with energy companies

Parking Eye enforce some of the pay and display parking bays where I work but use the Mark 1 eyball attached to a big bloke called Bernie who's actually quite a nice bloke.

A lot of private parking companies really don't talk to their staff or brief them properly. Manchester City Council has been through a few of these organisations after de-criminilisation. The current contractors are NCP which pretty much sums up the whole business.

Early contractors were put on bonus schemes with prizes on offer which led, in some cases, to Parking Attendants lurking in areas where they knew drivers would just "nip" into shops. This led to the Attendants using their machines to print the ticket before they approached the car and were then able to "leap out" and slap the ticket on the screen.

In one well known case in Salford a Parking Attendant knew that a person working locally used to turn up for work at about 7am and park on a 15 foot gap in the Double Yellow Lines before the Attendant could get there. He then came along one day with a can of yellow paint and a brush and painted the lines under the car and then, after taking a picture, issued a ticket. What he forgot is that other people had cameras as well and he was filmed on a cameraphone doing the dirty deed.

The ticket was cancelled before it even got as far as a tribunal.
 
From what I have read today elsewhere on the internet today these parking charge notices are invoices rather than fines, and as such have no legal basis. My son is adamant that he gave his reg in to the hotel and was assured that was all he needed to do. Also none of the others who he was parked with got a charge. So on this basis, and that we have already had one letter saying that the charge was cancelled, I am inclined not to even respond from now on, although I am guessing that this will be some sort of automated process which starts at a fine , (discounted if you pay in 14days) and escalates until they threaten to send somebody round to remove your finger nails.
 
Only a Statutory Body, such as a Court or the Police can levy a fine. Many of these things have the appearance of an official ticket, but are basically as you said, an invoice. I think contract law applies more here in as much as that when you park your car you are effectively entering into a contract with the owners of the car park. If you don't pay then it's like not paying your gas bill.

johnw is red hot on this kind of thing, but another poster, whose name I can't remember, is/was a law student and could quote chapter and verse on this subject.

Perhaps someone can remember his name.

Manchester Council Attendants still are. :bang:

I was parked in Ancoats in on-street parking bays. i parked in a gap between 2 cars in a line of 5. saw a Parking Officer on the next street and thought nothing of it.

Came back 20minutes before my ticket expired, found a Parking Fine Notice on my screen. the cars around me had left and it turned out that i was overlapping 2 bays.. £50 for an accident really. :cry:
 
For future reference, there is an all day for £3 car park just off Jersey St., in Ancoats that might be a better bet, although if you're only there for half an hour it's cheaper on-street, unless..............

Ignore it completely. Only fines (hence why they say 'parking charge notice) that you have to pay are Police and Council.

Thanks for your helpful advice. It goeas against the grain just to ignore things like this. I would rather take them on and win (obviously!) but I think looking at these examples it seems that these parking companies are just trying it on and hoping as many as possible they can scare in to paying up.

That's ridiculous. Have you been in touch with the hotel and asked them to deal with it?
 
So can you just park without paying intentionally then? just read a few threads on the money saving expert links and every one ignores the parking tickets? so whats the point in paying in the first place?

People get scared when they start sending letters threatening to take you to court and pay up.

Only parking fines you have to pay are from the Police and council. Infact, I dont think the Police give parking tickets out anymore?

Not until now!

Just had the first shot from Andrew McKerney & chums (aka parkingeye) – allegedly overstaying at a s/market site.

Not too fussed about it – seen one before (another outfit). In that instance they got a judgement somewhere - but I got it overturned in my local CC. They were a bit naughty. I wasn’t exactly in the car park where the ticket machines were - but in the loading-bay area to collect some heavy items. But the `Jobs-Worth’ wouldn’t be put-off his `kill.’ There was a notice at the back of the area (contrary to best-practice) – but cunningly by the time it got to court, their pics showed an area with a new paint job & decorated with multiple signs. When I put this to Corporal Jobs-Worth – he confessed … end ex!

I’m inclined to respond rather than fall silent. I understand they need to identify the driver. Consequently I’m tempted to go with the old S Yorks* police trick - `err sorry we refuse to tell you the name of the driver on the grounds s/he may be vilified & cause mental & physical health problems.’ But then again, that failed – with the information ruled as “inappropriately withheld” … & they were appropriately vilified. So may just fall silent & see what transpires.
