I am currently living in an extremely damp flat. I have informed my Lanlord no end of times and he put a vent in. He now thinks he has solved the problem even though I am telling him otherwise. The windows are condensating all the time now and there is mold on the walls that when you wip off, pretty much comes straight back. A lot of my clothes and furniture are being destroyed and my Landlord doesn't seem to care. The flat is also destroying my health.

Is there any way I can claim damages off him. I wouldn't mind if he was doing soemthing but he's not, even though I've told him time and time again.

This is my first flat as I was living with a friend before. I just jumped into this flat as I needed somewhere to go and didn't know what I was looking for. My tenancy is up next month so I am looking for somewhere else to live.

So any advice?

move out and learn a lesson
IMO its pointless fighting for 'damages'
how would you quantify that in court?
Having lived in a damp flat I can sympathise but I would say move on and get a better flat

complain to your concil. if they are good they will send someone out for free deem it unlivable then i dunno what will happen. try buying some mold away product if all else fails check direct .gov website

sounds like a crap landlord checked your deposite is protected as well?

He is , just cares that he's getting his rent and not fussed about anything else!

He has never mentioned that that is protected which I am now worrying about!

THis has been one of lifes hardest leasons for me so far!

well check on one of the 3 websites
Landlords or agents must use one of the three approved TDP schemes to protect tenants' deposits where these conditions apply. If any other scheme is used, deposits are not protected in law. The three approved schemes are:
  • Deposit Protection Service (DPS)
  • MyDeposits
  • Tenancy Deposit Scheme (TDS)
http://www.direct.gov.uk/en/HomeAndCommunity/Privaterenting/Tenancies/DG_189120

as said report to lincoln council. they will be helpfull

I've checked the sites an apparently isn't protected. I think a trip to CAB may be in order!

My house is that damp that my matreess feels wet, my slats are going mouldy.

Mould is dangerous as it realeases spores which have really bad effects on your health. I will post some picture of my clothes later, they have basicly turned white with mould. My furniture is all mouldy too. I will have to post pics, needs to be seen to be belived.

I live next to a river which might be part of the proble. There's no leak just tremendous rising damp. I'm also North facing so get no sun.

It is bad, I put clothes on in the morning that feel damp.

I do have central heating and no leak.

Do it!. My last land lord (right cowboy outfit) Didn't use the scheme and I managed to get the £450 deposit back PLUS £450 compensation and 'interest' for the time he was holding onto the money .

I tried doing it the 'nice' way but all I got was semi abusive letters back .

What I would say is you'll need to move first or they can make life difficult. Which I know can be a pain if your relying on that deposit for your next place :(.

Just forget it and move on. Unless you're licking the mold off the walls it won't be doing you any harm. I fail to see how condensation can ruin your furniture and clothes also...unless he's got the shower fitted in your livingroom.

Complete rubbish. My brother lived in a damp flat in London and ever time I walked through the door my asthma would flare up. Damp and mould are NOT good for your health.....

Spot on. The mould spores can cause all kind of illnesses and can cause existing conditions to flare up. This is a well known fact and any landlord should be aware of it.
The only way to get rid of the mould permanently is to cure the damp then remove all evidence of the mould.
Sounds like a call to the environmental health agency might be a good idea.

Definitely. I've got really mild asthma and I kid you not I'd be wheezing and a bit short of breath every time I walked through the door. I'd leave and be absolutely find within half an hour and if I went back I was wheezing again. I have REALLY mild asthma. I've never had an attack, but just walking through that door made me feel as if I was being choked.

I Said I would put pictures up so here you go, I have only been here for 5 months. Please also note that the pillow shown was only bought in September and the shirt has just been hung up in my wardrobe.
