Re: Traffic Offences & Legal Guide

What is the law regarding coaches in the "fast lane"? (Sorry for the bad terminology, I'm an old get who was brought up with slow, middle and fast!)
I was driving up the M1 last night where there is a four lane stretch. A National Express coach came past me doing about 75 in the fast lane. I couldn't think of any exceptions as to why he would do that!
I've also noticed loads of lorrys in the fast lane recently in roadworks, are all bets off there???

Slow middle and fast doesn't really work when there are 4 lanes does it?
So was the coach in the third or fourth lanes?

Re: Traffic Offences & Legal Guide

Here's what the Highway Code says about the Outside Lane:

Rule 265
The right-hand lane of a motorway with three or more lanes MUST NOT be used (except in prescribed circumstances) if you are driving
  • any vehicle drawing a trailer
  • a goods vehicle with a maximum laden weight exceeding 3.5 tonnes but not exceeding 7.5 tonnes, which is required to be fitted with a speed limiter
  • a goods vehicle with a maximum laden weight exceeding 7.5 tonnes
  • a passenger vehicle with a maximum laden weight exceeding 7.5 tonnes constructed or adapted to carry more than eight seated passengers in addition to the driver
  • a passenger vehicle with a maximum laden weight not exceeding 7.5 tonnes which is constructed or adapted to carry more than eight seated passengers in addition to the driver, which is required to be fitted with a speed limiter.

Depending on the circumstances, the Coach Driver was possibly being naughty...if it was a 2-lane motorway, then he was perfectly entitled to be there

If 1 lane was closed due to roadworks then that would be an exception to that rule. The other could be if 1 lane was marked as being the kind of slip road that is alongside a running lane but doesn't have an acceleration or deceleration lane. It can be frustrating to a coach driver who can do 65 but is caught behind a truck doing 56 but is no excuse.

AFAIK coaches have to have a speed limiter fitted like big trucks

Re: Traffic Offences & Legal Guide

PCV vehicles up to 12m in length are allowed to do 70mph maximum on dual carriageways or motorways.

PCV vehicles exceeding 12m in length are allowed to do 60mph maximum on dual carriageways or motorways.

Full table https://www.gov.uk/speed-limits

They should have a speed limiter fitted. However, the rules don't seem to imply that it has to be permanently enabled. I'm hoping they don't rely on just cruise control lol. But at the same time my van is restricted to 70mph and there are some coaches I struggle to get past.
