Hi all,

I need some advice.

I have written a long and very fair review of a very expensive and exclusive product I own and I want to publish it on my website once I finish the site. However, it's so fair that there's a heck of a lot of negative comments on the product as well as the good ones and the guy who supplies the product has past history with threatening legal action over comments made about his products, claiming for a loss of earnings in the region of £30,000 in the past. Although he backed off this claim when the other guys solicitor got involved.

I just need to know for sure I am safe to publish this review without fear of a lawsuit.

If what you say in the review is true then you have nothing to worry about. If it goes to trial you would need deep pockets and strong nerve and the law has been used in this way to muzzle legitimate criticism in the past. Robert Maxwell was very hot on this. I can say what I like now, you can't slander the dead!
 
add a disclaimer, something like:

I can't really say much about what I am reviewing at this time as a search for the topic may bring prying eyes onto this forum and the word would get back to those concerned. If anyone has an idea then please keep it quiet for now, it's something I did post about in the past so it wouldn't be that hard to figure it out.

It's funny but we are in a court case situation with a very large supermarket chain which should be coming to a conclusion within the next two weeks :slayer: and it'll be on the radio and in the papers too :rolleyes: :D

As for the review, it is exact and there is photographic evidence to go along with all the detrimental facts. It's more a case of the opinions I will be expressing about the quality and if the product is worth the paying price in my opinion, you know the sort of thing.
Everything mentioned has a reason for example something fell off the product after it's outer coating had also peeled off and I have said stuff like " this would not be acceptable on an item that is inexpensive let alone something costing thousands"

I have also mentioned items that are on the product and said how cheap they looked and I would not buy those again as an option and I would advise others not to either.

Surely I have the right to do this as any product available to buy is open to criticism or praise and if the suplier has an issue with it then they need to improve the product. People deserve to know what they are getting for their money and where they could also save some money due to parts not being worthwhile. ;)
 
its the internet, and if he's inviting buyers of said product (;) ) to post true and fair reviews/comments on his website/forum, then you should be able to do just that.

I think maybe what has previously happened is some chavvey gett that hasn't actually got one decided to write some nasty comments, and the producer of said product decided to take them to the cleaners.

as long as its justified, and you've got some kind of std forum type disclaimer than you have nothing to worry about.
 
It's not really the case as far as a chav is concerned, I know the guy in question and he is a well respected figure in the film industry, in fact he was involved in the making of ET himself and Kangaroo Jack, and tons more. It was him who was first slagged off by this firm in question and he then made a truthful comment about the firms product from first hand experience and the firm in question got all shirty and tried to sue for loss of earnings, which could never have been proven anyway and they dropped the whole thing when my associate got his own solicitor involved.

Being invited to post reviews of the products has NEVER been encouraged, in fact if anyone has spoken out in the past it is always met with total denial and something like amazement that you don't like something and it's always turned around so you are in the wrong and not him. He has such a strangle hold on the community as he's the front runner of the only club in the country and others are scared to speak out
in fear of being forced out and unwelcome. He's a bully in other words and I ain't bothered by him, I just want to cover my back legaly before I publish the site ;)
 
I spoke to my solicitor this morning and this is basically how it goes
