Go through the insurance, cover your own back. the insurance will sort his courtasy car out... you really should just tell him not to contact you, let the insurance do the work. and at worst, whats you insurance gonna go up by? £200 max??? like i said, mine went down.

Yea but:

1. He was too close to me in the first place when I reversed.
2. The garage he is getting the repairs and curtesy car from is literally a 10 minute walk to work or 2 minutes in a car...its down two roads.....

He stopped while there was space between his car and yours. You didn't stop until your car hit his. Not his fault, its yours. Accept that you made a mistake and learn from it.

I already pay whey too much over £1000 for insurance already, so every penny counts at the moment.

Ok cool, just as long as I know I am paying for what I need to pay for ONLY, and no extras thats fair enough. I am not one of those people that would cheat someone out of money, I was just making sure that he isnt getting any more money then he needs from me.

well hang on, my 1st years insurance was £1669.72p third party on a 1.2 clio it was written off, with personal injury involved, i got a 1.155sx punto, my insurance stayed the same price, then the 2nd years insurance with zero no claims was £1571.0p

and everything was legal and above board, what about the next person to buy his car? they wont know it could possibly be a write off...

i reccomend using your insurance....

Problem is that the law is on his side. If he is without his car for 24 hours for repairs that is all the proof he needs to provide to be entitled to a courtesy car. He doesn't need to show that he can't manage without one. He has a right not to be disadvantaged by the actions of another driver. He doesn't even need to drive the replacement car - he could sit and look at it all day if he wanted to.

Your best chance of making sure he doesn't rip you off is to put it through your insurers.

whats too close?
ive seen people leave between 6ft and 6cm between cars
the idea is the car infront will go forward at a junction or do we leave 50 yds between just incase?

If the other car was stationary, then it's automatically your fault!

I would go through insurance and just let them deal with it. After all, that's what you've paid them for.

Don't go outside insurance, because it will probably cost more, and does sound dodgy that the other driver dosen't want to go through it.

Have you checked for CCTV locally?

Don't claim he went into the back of you, because that is just knobish. Think of how you'd feel if the roles are reversed. Just put it down to a learning curve at the end of the day. I hit a transit, was blantently my fault, I admit that, and I've learnt because of it

It doesn't sound dodgy at all. The BMW driver has said he will accept cash. That gives the OP a choice. He isn't refusing to put it through his own insurers - that would sound dodgy.

i would seriously ring the insurance, then its out of your hands, and as pointed out about cctv, they will try to see if he was also moving at the time of impact, if he was you might get away with knock for knock... just use your insurance!!!
