Very Stressed After Crash

Hi, On saturday afternoon i was driving around the outer circle of morrisons carpark in bellevale , liverpool and as i was driving round some guy came out of a junction not giving way and you can guess what happened next...

As me and my husband got out the car the guy was very appologetic and couldnt say sorry enough, I got home and called my insurance company and explained what happened. obvously he was at fault and he admitted he was at the scene.

Now i find out after my insurance phoned his insurance company that they are disputing liability and the third party stated that i was entering a junction as he was coming out?????? I am really mad why anyone can lie like that.
I now have to wait for a form to arrive and i have to fill it in and draw a diagram of what happened. I have taken photos of my car and taken photos of the place where i occured. My insurance company said to me that there is no way the third party's insurance can dispute the claim as the state that my car is in. The third party's car is scuffed on the front but my cars bumper has gone right in and the wing has dropped down to the point its clipping the passengers door as it opens. I have included photos of my car for you all to look at and your point of views. I feel like i'm in limbo and i'm so stressed out that i just feel like giving up on life, . My mind keeps thinking very negative and this person might get away with what he's done. but my insurance company is very confident.Has anyone been it the same situation if so how did it go for you? . Please Help My Guys..I'm just begging for help.

Get yourself down to the supermarket ASAP ask to speak to the Store manager ask nicely if there is any CCTV of the carpark showing your accident Its a long shot but worth a try...

Yeah thank you for that message, i have actually thought of it but my husband said i might need the police to do it hehe..not sure wether he's right?? but i might give that a try tomorrow..thank you..

usually with the damage of the two cars and the sketches and photos of the location of the accident they can give a good determination on what happened. They did with me. The guy that was claiming against me (it was his fault) said i had smashed into him. My insurance backed me all the way and it went to court and he showed himself to be liar!

thank you for your message, i'm glad to say that i'm fully comp and have legal cover on my insurance. my car is going to vauxhall lookers to get fixed on monday and i'm getting a courtesy car. but i' now worried that i may have to fit the bill for all this...

Make plenty of sketches - use googlemaps to find the store and zoom in as far as the aerial photos will go. Save a copy of the photo, put it in paint and draw on the cars, directions of travel and point of impact.

You got him admitting fault!

Sadly, it's human nature to gain from something and he's probably got home and decided he would try his luck. Did you get any witnesses? Any photos of the scene?

It's well worth going to security at Morrison and asking them if CCTV caught anything.

Excuse the cliche, but at the end of the day, all you can do is help your insurance company as much as possible. Their confidence is a good sign.

Unless he comes clean and admits it was his fault, be prepared for a long, drawn out battle. That or if your insurance company can get enough evidence to prove the true version of events. Disputes can take a very long time to settle.

I was fuming when I was accused of all the sins under the sun by solicitors acting for the third party in my accident, which was quite clearly his fault. I felt just like you describe, infact; how could someone be so damned dishonest? After a while, you realise it's actually most likely the solicitors taking the third party's version of events and cooking up the accusations. I like to think the truth will prevail - let's hope so, hey.

Thank you Hellcat, great idea..I'm actually waiting for a letter off my insurance company where i have to draw a diagram of the incident. so i might do your idea for the diagram..thanks

De Ja Vous... almost exactly the same situation my car was in. Except in tescos car park and he admitted fault and stuck to it and the car was slightly more damaged.

Dont want to cause any undue stress but My sister had an accident at a roundabout last August the 3rd partys insurance has paid us the excess back, cost of hire car, repair bills but is still arguing over the % liability we are adamant my sister was not at fault (dozy old dear drove into the front wing) as she entered the roundabout (failed to give way) and its still going through the motions.........

It's still ongoing - happened April 10th this year. Being fully comp, you should have your car looking good as new again fairly quickly. The battle will still rage on 'behind the scenes' over liability, though you'll be spared the reminder of it every time you look at the car

Best of luck with it and definitely see about getting lots of pictures, the Google earth suggestion etc. etc..

maps.live.com (copy that as it stands into the navigation bar) offer a birds-eye view (if it covers your area), which is usually better quality than satellite imagery

Well Clair i just knew this would happen, seriously, hence the reason i said in your other thread that the other persons insurance company would try it on. I have been there and i know what it's like. Keep on at your insurance company when you get the maps done and get as many photos in as you can. If you can, get photos of other vehicles approaching, and on the round about. I take it there were no witnesses?

Hi guys..
My insurance company asked me a couple of times''what did the guy say at the scene'' and i just told them exactly what he said..''oh my god i'm really sorry, its my fault just claim it off my insurance'' and he still kept saying ''i'm really sorry''... There were me, my husband and too children whom where sobbing in the back of the car.
The way we collided he ended back behind the giveway lines and while we where giving details to each other he said '' i'm behind the give way lines'', BUT my husband was quick on the draw saying ''No mate you where well over the lines'' He then never said nothing!
If he was behind the giveway lines we wouldnt have hit. As i was going around the outer circle of the carpark and he was coming out of one of the junctions.

On my pictures there is no way he could say it wasn't his fault.
you can clearly see it in my photos, the impact.
I have downloaded google earth and saved photos of the carpark and i'm going to use them with my own drawings of our 2 cars and how it happened.

What does anyone reckon of the damage to my car in my first message above...VIEWS PLEASE. you can click on them to make them bigger

NOW with him addmiting liability at the scene will that go against him or will it be my word against his...vice versa.?

without an independent witness it would be seen as your word against his

as for damage to your car it really is hard to say the damage to my mothers car my sister was driving came to about £1500 its not what you can see (cracked bumper etc) but whats behind in my mum/sisters case it was a new wing (even though it wasnt damaged on the surface the headlight mount which is spot welded to the back of the wing was pulled off =
havent got the pics on my pc or i'd post them..

new wing,
new bumper,
new front cross member/crash protection bar
new arch liner,
new head lamp
wheel trim
plus labor and the dreaded VAT

nearly wrote the car off
