Hi guys your input on this will be much appreciated.
Sat 29/12 i was involved in minor collision (other guy shunted the back of my car).
Police attended scene and other party will be charged with driving without due care and attention.
Rang my insurance (swiftcover.com) and explained all and guess what???????
They are washing their hands as my insurance policy is only a third party,fire and theft and as such does not cover my damages!!!! would you believe that????
now made a claim on other party insurance(company car) and on thursday i am going to contact the Financial omdusman service to see where i stand legally with my insurance.
Any advice please?
 
As it clearly wasn't your fault the other persons insurance will pay out won't they?

I would have thought your insurance company would be obligated to communicate with the other parties insurance company on your behalf though.

your insurance are correct in not paying out as you are only covered for fire/theft or damage to another person or car, not damage to your car.
however as its not your fault then the other persons insurance company are liable to cover the costs. if you have legal cover on your policy swift cover should be contacting the other company to get them to pay out.

If you wanted your own car covered by your own insurance for accidents that are YOUR fault you need 'Comprehensive" insurance.

But as you say its there fault so it will be their insurance covering damages. Don't forget to claim for whiplash too ;).
 
Even the minor bumps can be fairly stressful if there's any hint of things not going according to plan. A couple of weeks ago a mini-bus reversed into the front of she who must be obeyed's Stilo. This could be a classic case of the other driver claiming I had run into the back of him. As it happens the bump took place at the airport where I work; and so does he. He also knows what I do for a living. It's quite possible the other party wouldn't have contested the claim anyway. But now it is all being cleared up. During this episode I went to my local FIAT bodyshop who asked if I wanted to go through my own insurance or deal direct with the other party's. I chose to keep mine out of it. Time will tell if that was the right decision. The bodyshop use a firm called the Claims Recovery Agency, who in turn use a firm of solicitors in Stockport. Sounds complicated doesn't it? Back to you, eventually. The fact the other driver has been charged with due care should virtually sew it up for you. Make sure you have the other driver's name, address and insurance company details. You will also need the collar number(s) of the officer(s) who attended the incident. If you haven't already done it, make sure you have a diagram of the road layout, positions of the vehicles and any other details such as weather conditions, road surface, available light, lights on vehicles and indicators. Winesses, if any, would be useful. Don't forget to write down anything the other driver might have said such as "Sorry" or "My fault". Most companies advise their drivers to not make any comment at the scene as this can be taken as an admission of liability. When you have filled out the claim form make a copy. I would expect the other party's insurer should also pay for any incidental losses such as hiring a car. Many body shops have their own as they simply claim the costs from the insurers. Don't be pushed into accepting a settlement that is less than you think. Remember, the purpose of insurance is to put you back in the position you were before the incident. With that in mind you should be going to a body shop that will supply genuine FIAT body panels to keep in with the anti-corrosion warranty and they will need to stamp the service book. Yesterday 31/12/07 rung other party insurance to make a claim and they didn't know anything about it, other party didn't even report it to his own insurance. Anyway i will claim everything possible.
 
Sorry to hear of your mishap. In my last bump, guilty 3rd party admitted liability to witness and i'm fully comp with lots of no claims protected to the hilt. When I contacted my then insurers HSBC on their 24hour accident line, they weren't interested. Broker Swinton put me on to their accident management service whom stepped in and took over, supplied courtesy car etc. Their approved repairer repaired the car badly twice, complained & got nowhere - thus traded it for my current JTD.

Don't understand why insurance companies won't deal with claims like they used to 7-10 years ago, don't seem to have any interest in non fault accidents whether your TPF&T or Fully Comp. If your TPF&T, drivers legal protection is a must, as it will cover the cost of solicitors acting on your behalf and get you your money back on your uninsured losses - i.e. damage to your car in the event of a non fault accident.

Police involvement in this instance should see you alright - Good Luck (y)

there's solicitors out there that will do that for free and recover their fee's from the third party's insurance no need to pay for it yourself :eek:. Theres one in the north east of england called 'wins solicitors'.
 
Update:
other person admitted liability to own insurance and they are dealing with the whole case.
Courtesy car already in my possession, cheque for car seats replacement almost banked(should be here mon-tue), and repairer booked my car in for initial assesment.
they have also instructed injury & phisyo specialist to asses injuries and solicitors to claim compensation.
Looks like everything is falling into places.

i was in a crash a few weeks ago at a junction there were lights on the main road and they had just gone on amber and when i double checked there was no one there went to edge out and a bike went and hit the front edge of my car he was obviously not looking where he was going as he could of clearly gone round me :mad: and my insurance wont fix my car at all as im only third party fire and theft and when i told my insurance they told me its the other drivers fault and not heard anything since. but if it isnt your fault why are they washing there hands of you that clearly isnt fair?

Because there not obliged too. It was up to you to get there details and ring there insurance to make a claim against them. Unless you have legal cover provided with your policy which I assume you dont?.
 
Insurance can be a nightmare! my claim from june last year as only just been settled! though I have to admit, Virgin were brilliant and fixed my car and gave me my NCB on my renewal even though it hadnt been settled, simply because they thought it would be settled in my favour!
 
Car Insurance is a product, and like all products you get what you pay for. Policies are NOT all the same and because one company offers something under the terms of a particular policy it doesnt mean all the others will under their policies. Unless you read the small print and take time to understand what you are actually getting you might be "dissapointed" when it comes to the crunch...........If you buy the cheapest policy you can find, it follows you will only get the bare minimum with no frills.

yeah well ive never been in this situation before so i didnt know what too take so therefor i didnt take any insurance details exept frrom contact details & address and the other guy did the same and he later foned and asked for my details which i gave him thinking he would give his details but he refused to give any so ive told my insurance that he refused and have left it upto them they said they would notify me of any changes but they havnt been in touch as of yet. and yes i do have legal cover.
