carol nash motor insurance. they insure my bike and said that they would do my car for a cheaper price so i went to them

I'm not certain on the TPFT rules, but as far as i'm aware they'll only do what the policy states. Pay out through fire or theft. And obviously pay for the other car to be repaired if the accident is your fault.

You'll find it difficult to get a pay out if its the other drivers fault.

If the other guy is taken to court and forced to pay for the damage, (he should be taken to court for his offences anyway) then you will get some/all of the money... but that could take months.

Direct Line says the driver of the insured vehicle must first appoint a solicitor, which will be free if the driver has legal protection insurance. Secondly, once it is formally established that the third party has no insurance, the solicitor applies for a claim form from the Motor Insurers' Bureau. The bureau then investigates the claim and once it has decided that the uninsured party is liable, will go about assessing a payout in the usual way. The MIB will also seek to recover its costs from the uninsured driver, but admits that it rarely recovers much.

But although the MIB acts as a protection against uninsured drivers, it doesn't mean that a crash with an uninsured driver is cost-free.

I just hope he paid for legal protection - i didnt and i've had to do all my fighting by myself for my crash.

Really sorry to here about you misfortune.

Unfortunately some police (not saying all) do take this sort of attitude & thats why so many people do it, they're happy to extort us for speeding fines from cameras, but catch the reckless little ****s that drive NoGos without insurance, no way, to much like real work!

My mate got side swiped in his Golf MK3 GTi by a SAAB convertible, he got the guys address, number plate, phone number etc in the usual transfer of details in a minor accident, gave all this to his insurance company only for them to come back and say the other party did not have insurance and without a crime report, nothing could be done. Mate goes to police station to report accident a week after it happens to get a crime reference number & inform them of the guy having no insurance & they couldn't be bothered, in fact they when my mate got uptight about this they threatened to charge him with leaving the scene of an accident!!!!

Cost my mate £650 to fix his car!

& they wonder why the publics perception of them is at its lowest level ever

law in this country *grrrrrr* best call the police for ALL accidents then just to be on the safe side! and get the other person involved to make you a written declaration there and then and make them stay til the police do come! and if they dont then make them stay there til you can get the police to come! that might persuade them to pay more attention to real crime out there.
