Hey ho peeps,

As some of you may know some knobber ran down my dog a few weeks/months back which inevitabley lead to the dog being killed...

Knowing that it was our fault really as the dog shouldnt have been out (someone let her out) we was preapared to fix the guys car who had hit her.

We gave the guy our details and said get in touch with us and well sort it out but nooooo, hes gone to a claims place to sort it :/

So we gets the bill through today for damage to his car, bear in mind a small peice of plastic had broke off the bumper that is it, nothing else.

Here we go

Was a ford focus 55 plate repair work done by Ford themselves.

Body Carry out repairs to estimatre £146.28
Body Air Con Recharge £50.00
Excess element of insurance repair to be paid £150
Bodyshop paint and materials £3
Deflector air x1 £4.87
Deflector air x1 £11.13
Condenser assy £164.72
Anti freeze x3 £9.50
Bumper assy £184.87
Radiator support £11.90

Amount owing £605.83 + £150 for insurance excess

Total payable £755.83 (plus the amount we had to pay to have the dog put down which was like £100)

Is this guy taking the **** or what ? he claims the dog ran out into the rd although we know this not to be true as it had had a stroke and was unable to hardly walk never mind run out into the rd.

My dads quite annoyed and has the OMG see you in court attitude which i know will end up in him loosing and this £800 debt turning into a 3 - 4k one..

What you guys recon, dad said to me earlier than he didnt know what to do and asked me what i would do, i honestly dont have a clue, i dont know if this guy is taking the mick or what.. what you lot think ? pay it and have done ?

I think its extremley unfair some jova or fkin takeaway menu delivery guy has let the dog out and its then been hit by a car and its costing us nearly a £1,000 because of it.

Do you think the work carried out is necessary ?

Would really love your opinions guys & gals, really dont know what to do about this one..

Cheers

i'll be honest and say i see little out of the ordinary there.i dont know the car so cannot comment on A/C compnents but it seems in order and if its a main dealer then it seems right.
remember in his place oyu would most likely go to the dealer as well

edit: isnt the excess included in the parts prices as its on the toal amount not plus?

Sorry, no on the bill we have here it says -£150 but on another letter overleaf it says about the excess of £150..

like i said total ammount they want to claim is £755.83

if id of hit someones dog i would have been sympathetic and would have thought it may end up costing me something somewhere along the lines,

its annoying how hes gone to a claims place rather than sort it out with us, we told him well sort everything out for him, we wouldnt have told him where not paying it where not like that, where nice genuine people.

i dont get why theres stuff on their regarding the air conn and why are we paying for the guys anti freeze lol ?

dont get me wrong where not tight, if its right then well pay it just seems way more than we was expecting.

well they fitted a new bumper.
theres a radiator support and A/C condensor.
so the if the radiator was dislodged/damaged they will refill the coolant.
same goes with the compressor but i would be finding out where that is on a focus as to whther it could be damaged in that impact.again if a new compressor(or any AC part) was fitted then the system needs regassed.

Sounds about right, you maybe able to save a bit not going through a main dealer, but i would have taken it there if it was me! ask him for 2 or 3 quotes as all insurance companys do to confirm the price and go from there, they probably removed the rad to refit the aircon rad as there fixed together! Ant!

May be worth checking if your home insurance or any personal liability insurance you may have covers pets, i know my membership of the British mountaineering council covers me for personal liability also covering my dog.

But as said the aircon radiator may have to be removed to fit bumper etc, so aircon regass is included. Just be thankfull they arent claiming for injurys or loss of confidence. ie cant drive because there scared the same will happen again.

I feel sorry that you've lost your dog, i do its hard enough without all this to deal with as well.

Hi, as this is only a civil matter and less than 5k i would say take me to court, the worst that can happen is you get another £30 (or what ever the costs are now for the small claims court are now),
Make him an reasonable offer, you have stated that only a piece of plastic has come off (did you get photos?) the likely hood is that the ac isnt faulty either unless it was a MASSIVE dog. I hit a fox on my stilo and i had to replace the bumper and that was it, that was also at around 35mph, if it was a residential area then you could put the fact that he was speeding to cause this amount of damage to his car.
I think he is taking you for a ride and wants his car fixed for problems that may have already been there.
Just out of intrest did the airbags go off? if they did then there could be more damage, but i suspect they didnt so i doubt very much that he has the sort of damage as he is describing.
Good luck, it maybe a good idea getting some legal advice from the CAB, you may find that you are not actually liable in this case, im pretty sure any liability ends at the property boundarys, but in not 100% sure, get some legal advise first before you choose which direction to take it.
roy.

ps, why the hell is he trying to charge you his excess when you will be footing the bill, there would be no excess if the bill is payed without insurance company intervention.
